22 of the 1906 Imperial Act. That Section 22 refers to Section 283 of the Imperial Act of 1894. Section 283 refers to a Master receiving on board an excess number of passengers and Section 22 of the Act of 1906 provides that passengers found on board shall for purposes of Section 283 be deemed to have been received on board at the place where they are found.

Section 283 was apparently purposely altered to suit the requirements of the Colony, and there therefore seems to be no good reason to introduce this amendment of Section 283.

A further point in connection with Section 12 of the Principal Ordinance is that there is apparently no such thing as a passenger certificate. Under the provisions of Part III the Certificate which a passenger ship requires is a certificate of survey see Section 10 (3) and (10). This certificate mentions the number of passengers as one item only among many others, as some confusion might arise between this passenger certificate and the passenger licence required under Ordinance 1 of 1899 and that required under Sections 37 and 38 of the Principal Ordinance, it would be as well to read in Section 12 (1) and (4) "Certificate of Survey" for "Passenger Certificate".
